Midterm Review Ruling On Nucleotide Food Additives From Indonesia And Thailand

On September 25, 2012, Star Lake Bioscience Co., Inc. Zhaoqing Guangdong as the Applicant, submitted an application to the Ministry of Commerce of the People Republic of China (MOFCOM) for a midterm review on anti dumping measures on nucleotide food additives listed under the HS codes of 29349990 and 38249099 originating from Indoneisa (PT. Cheil Jedang Indonesia and PT. Kirin Miwon Foods) and Thailand (Ajinomoto Co. (Thailand) Ltd.).


The Applicant was asserting that after final decision the dumping margin of nucleotide food additives imported from the aforesaid producers and exporters to China have increased and exceeded the rates of anti-dumping duties determined in the final decision. Thus, the Applicant requested to re-calculate the dumping margin in the past one year and to revise the rates of anti dumping duty accordingly.


Within the specified time, Ajinomoto Co., (Thailand) Ltd. filed a response and submitted their answer sheets to MOFCOM. On the other hand, PT. Cheil Jedang Indonesia and PT. Kirin Miwon Foods neither submit the answer sheets nor cooperate with MOFCOM in this investigation.


Based on the result of the investigation, MOFCOM proposed suggestions to modify relevant rates of anti dumping duties and on August 6, 2013 released its Announcement No. 39, 2013 which ruled as follow:

The above Announcement came into force on August 7, 2013. If the two Indonesian companies decided to cooperate with MOFCOM, they may request for a mid-term review and file the application before September 8, 2013.
